Video Game Plagiarism, How Can Remove from the Law?

Disclaimer: This opinion is very objective based on facts.

Creating an original work must never be separated from research, thinking very deep, and the needs of humanity. A work can be said to be original if the underlying ideas or thoughts never created or owned by someone else. Sometimes an original work can be a revolutionary work that changed the general outlook for something new. Not infrequently these works was followed by several other companies, individuals, or other artists to adopt a work with the same basic idea, but it has a different concept.

This also applies to video games. Call it the easiest Command and Conquer belonged to Westwood Studios, which followed nearly many video game companies. Examples such as Blizzard with WarCraft her, Microsoft and Ensemble Studios' Age of Empires hers, Liquid Entertainment with Battle Realms , or Defense of the Ancients (DotA) works IceFrog, Eul, and Steve Feak which then licensed by VALVE into DotA 2 we know so far.

But with the growing age, original work as mentioned slowly began to dissipate its existence. This is due to the high market demand for something less the same. Evidently a lot of games AAA (or with similar graph AAA games) with a similar theme that is more salable and popular than some other new game ideas. These conditions lead to the emergence of games that have the same mechanism, but does not differ much from the original game idea anyway. Not infrequently, these conditions led to some companies "naughty" were actually just copy and paste all the elements of the original game and re-skin across the existing assets in the game for the sake of profit.

Remember you when we preach some plagiarism game Overwatch from China that appeared on the market? Or cases that had broken out between Riot Games and Moonton? Are they really doing plagiarism and worthy of prosecution?

Let us look the case of "plagiarism" that occurred in the video game business. Video games are made with a different code, and other programmers outside the original programmer will not be able to access the code and to copy and paste the code. However, they can make a case that has the same mechanism. Even so, they will not work the same as the original code. Examples of the most easily seen is games plagiarism or clone of success Flappy Bird  or Mortal Kombat . They can make tap mechanism similar to Flappy Bird , but will never be the same as Flappy Bird . Similarly, the Mortal Kombatimitated by several companies to create the exact same game without any changes at all. They can not make things taste the same as the original. For example, the video below that shows how easy it is to other developers could create something similar with the ability to double-jump dash or belonging Genji in  Overwatch using Unreal Engine 4. Will it be similar to the original? Visually yes, but will not be identical to the original.

Whether from the above examples that game makers can be sued? Yes and no. A video game is said to be "qualified" to be prosecuted if they copy everything and said that the game is homemade. So for example ya, there is an independent developer that makes a remastered version of Battlefield 2 with another title Battlefield: Assault for example, then they are selling as their work, then they deserve to be prosecuted. Or, you take on the character Darth Vader from Star Wars and put it in the game yours without a license agreement at all on Lucas Film as the owner of Star Wars, Then you deserve prosecuted. But if they make it from scratch with the same elements and different titles, then their work can still be said to be the original. Although the game can still be said to be a clone or plagiarism, but they " literally"  to be freed from the law because it makes all of its own content though not entirely original. But for a decision demanding demanded back again, we submit the original developer policies, whether they want to prosecute or not. Y ou know , without any action from the original maker of the game plagiarism or clone, it will remain on the market.

Then, what if you make the same game but with various changes or adding new features / different in it? Or make the same game but with a different look? Is it also includes plagiarism and is illegal? The answer is no. Back as our example in the beginning of the article, whether WarCraft, Age of Empires, and Battle Realms is a plagiarism of Command and Conquer ? No, right? Because they actually give birth to a new genre with the same basic idea with Command and Conquer .

If you restrict thought that plagiarism is something illegal just because they have "the main idea is similar", then you will not find a title or genre other than Command and Conquer or DotA . It is at once deadly new genre in a video game. Some of these games there since everyone has taste different. For example, someone who just wants to play FPS games that not only emphasizes teamwork, but also skill and a bit of casual element in it will choose Counter-Strike than Call of Duty faster and casual example. With the formation of this, the video game business competition will be more impressed fairin each genre. Player also will be judging "Well, this game is better than the original / who became his inspiration" rather than "Basic game plagiarism, not quality".

What do you think? Are there any games plagiarism or have a similar basic idea that you think is better than the original? Or, you'll never play the game of plagiarism and assume that the plagiarism game developers deserve to be punished?
